GENERAL TERMS AND CONDITIONS LITTLELEND

1. Definitions
In these general terms and conditions, the following terms are used with a capital letter:
LittleLend: the online platform accessible via www.littlelend.com.
Platform: the website, application, and all related services of LittleLend.
User: any natural person who registers on the Platform, whether as Lender or Renter.
Lender: the User who offers a Product for rent via the Platform.
Renter: the User who rents a Product via the Platform.
Product: the children’s item offered for rent by a Lender.
Booking: the rental agreement between Lender and Renter for a specific Product over a defined period.
Rental Period: the period during which a Product is rented, from start date to end date.
Deposit: the amount paid by the Renter as a security deposit for the Product (standard €25.00).
Platform Fee: the fee charged by LittleLend for using the Platform (10% of the rental price, minimum €1.50).
Damage Cover: the optional coverage of €2.50 per Booking.
Payment Fees: the transaction processing costs via Stripe (€0.29 per transaction).
2. Applicability
These general terms and conditions apply to all legal relationships between LittleLend and Users, including registration, use of the Platform, and all Bookings made through the Platform.
By creating an account and/or using the Platform, the User declares to have read and accepted these general terms and conditions.
Deviations are only valid if expressly confirmed in writing by LittleLend.
LittleLend may amend these terms. Changes will be communicated at least 30 days before taking effect via email and/or the Platform. Continued use after this period constitutes acceptance.
If any provision is void or invalid, the remaining provisions remain in effect. The invalid provision will be replaced by a provision that most closely reflects its purpose.
3. The Platform and Services
LittleLend provides a platform through which Lenders can offer and Renters can rent children’s items.
LittleLend acts solely as an intermediary and is not a party to the rental agreement between Lender and Renter.
Payments are processed via Stripe. LittleLend is not a payment service provider and bears no responsibility for payment processing, except as required under these terms.
LittleLend strives for 24/7 availability but does not guarantee uninterrupted access and is not liable for (temporary) unavailability.
LittleLend may modify, expand, limit, or discontinue the Platform or parts thereof at any time.
4. Registration and Account
Registration and an account are required for use.
Registration is permitted for natural persons aged 18 or older residing in the Netherlands.
Upon registration, the User provides accurate and up-to-date information, including name, email, phone number, residential address, and a password (minimum 8 characters with at least 1 digit). The User keeps this information updated.
The User is responsible for keeping login credentials confidential and for all activity under their account.
In case of suspected misuse, the User must immediately notify LittleLend; LittleLend may take security measures such as resetting passwords or temporary suspension.
LittleLend may refuse, suspend, or delete accounts in cases of incorrect information, breach of terms, abuse/fraud, or improper conduct.
Use of multiple devices is permitted as long as it does not conflict with security or abuse prevention measures.
Account deletion can be done via the account settings or contact form; personal data is processed in accordance with the Privacy Policy.
5. Obligations of the Lender
The Lender is the owner of the Product or otherwise entitled to rent it out.
The Lender accurately describes the Product, including title, description, category, brand/features, clear photos, daily price, and any known defects/limitations.
The Product must be safe, compliant with applicable laws and standards, clean, complete, in good condition, and free of hidden defects. Products subject to a recall may not be offered.
For baby and children’s products, the Lender must provide proper usage instructions and mandatory parts (such as straps, mounting materials, and manuals). Car seats and similar safety items must not be expired, damaged, or previously involved in an accident to the Lender’s knowledge.
The Lender makes the Product available at the agreed date and location and delivers it in the advertised condition.
Response to an approval request must occur within 120 minutes; otherwise, the request expires automatically.
The Lender may reject a Booking for legitimate reasons, such as doubt about safe use or proper return.
After return, the Lender must confirm via the Platform whether the Product was returned. Late returns must be reported within 24 hours.
It is not permitted to offer illegal, dangerous, or infringing Products, or Products outside the allowed Platform categories.
6. Obligations of the Renter
Pickup on the agreed date and location unless otherwise arranged.
The Product must be used according to its intended purpose and the Lender’s/manufacturer’s (safety) instructions.
The Renter must handle the Product with care and return it in the same condition, considering normal wear and tear.
The Product may not be sublet, lent, commercially used, or modified/repaired without permission.
During pickup and return, the Renter should take photos via the Platform to document condition. Any discrepancies must be reported immediately.
Damage, loss, or theft must be reported immediately to the Lender and via the Platform.
The Renter is liable for any damage occurring during the Rental Period unless due to pre-existing defects or normal use.
For late returns, the Renter owes the daily rental fee per extra day (up to 30 days), deducted from the Deposit.
7. Booking Process
a) Instant Booking: the Renter selects Product, Rental Period, and optional damage cover and pays via Stripe; the Booking is confirmed.
b) Booking with Approval: the Renter submits a request; the Lender must approve or reject within 120 minutes; after approval, the Renter has 120 minutes to pay; after payment, the Booking is confirmed.Bookings can only be made for future dates, at least 1 day in advance.
Upon Booking, the Renter pays: rental fee, Deposit (€25), Platform Fee (10%, min. €1.50), Payment Fee (€0.29), and optional damage cover (€2.50).
If payment is not made in time, the Booking automatically expires.
LittleLend may refuse or cancel Bookings if fraud, misuse, or breach of these terms is suspected.
Bookings for a specific date/period are exempt from statutory withdrawal rights under Dutch law for time-bound services.
8. Payment and Payout
All payments are processed via Stripe; Stripe’s terms apply.
The Renter pays the full amount upon Booking confirmation.
Funds are held and managed by Stripe; LittleLend does not hold client funds outside of Stripe.
After completion and confirmed return:
Lender: receives the rental fee minus Platform Fee (10%, min. €1.50) to their Stripe Connected Account.
Renter: receives refund of the Deposit (€25.00) minus any extra rental costs due to late return.
In case of a dispute, payout may be temporarily suspended until resolved via the Platform or by a competent authority.
Lenders require a Stripe Connected Account and must provide the requested details.
LittleLend is not responsible for delays caused by incomplete or incorrect data or restrictions imposed by Stripe.
Platform Fees and Payment Fees are non-refundable unless the Booking is cancelled by the Lender before start or cannot proceed due to a cause attributable to LittleLend.
All amounts include VAT where applicable.
9. Cancellation and Refunds
By Renter: only before the start date; full refund minus €0.29 Payment Fee. No cancellation during/after the Rental Period.
By Lender: before the start date; Renter receives full refund minus €0.29 Payment Fee.
Rejected requests: no payment, no fees.
Expired requests: Booking expires without cost.
Refunds are processed within 5–10 business days depending on bank/payment method.
10. Deposit and Damage
Each Booking requires a €25.00 Deposit.
The Deposit covers damage, loss/theft, late return, and non-performance.
Upon proper return: full Deposit refund.
Late return: additional daily rate per day (max. 30 days), deducted from Deposit; remainder refunded.
Damage: Lender reports within 24 hours after return with photo evidence; parties first attempt resolution; if unresolved, a dispute may be filed via the Platform.
Loss/theft: must be reported immediately; in case of theft, a police report must be filed and shared; the Deposit is applied; Renter is liable for any excess.
Damage caused by intent or gross negligence is fully at the Renter’s expense.
11. Damage Cover
The damage cover is an optional facility provided by LittleLend and not an insurance policy. No insurance product is mediated or offered; the AFM does not supervise this coverage.
The Renter may opt for damage cover of €2.50 per Booking. Coverage applies only to accidental damage during normal and careful use within the Rental Period and reported within 24 hours after return.
The maximum coverage per Booking is €200. Normal wear and tear is excluded.
Excluded: loss or theft, damage outside the Rental Period, intentional or grossly negligent damage, and untimely reported damage.
Claims must be submitted via the Platform with photo evidence and relevant information. The User cooperates in any investigation.
LittleLend assesses claims based on pre-defined and objective criteria and may request additional information. Approval is not guaranteed.
Payouts under damage cover are made to the Lender, deducting the Deposit if applicable.
The damage cover fee is non-refundable.
12. Reviews and Ratings
After completion, parties may review each other.
Reviews must be honest, truthful, and respectful.
Not allowed: false/misleading reviews, compensated reviews, inappropriate content, or sharing personal data.
LittleLend may remove inappropriate reviews.
Users cannot edit/delete reviews after posting, except when violating these terms.
Reviews are public and may be indexed by search engines.
13. Intellectual Property Rights
All rights to the Platform belong to LittleLend or its licensors.
It is prohibited to copy, publish, reverse-engineer, or scrape the Platform in any automated way.
By posting content, the User grants LittleLend a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and publish such content for the operation and promotion of the Platform.
The User guarantees that they hold all necessary rights and indemnifies LittleLend from third-party claims.
14. Privacy and Data Protection
Processing of personal data is done in accordance with the GDPR and the Privacy Policy.
See the Privacy Policy available on the Platform for more information.
By using the Platform, the User consents to processing as described in the Privacy Policy.
LittleLend implements appropriate technical and organizational measures.
User rights: access, rectification, erasure, objection, data portability.
15. Cookies
The Platform uses cookies and similar technologies.
See the Cookie Policy on the Platform.
Preferences can be adjusted via the cookie settings.
16. Liability
LittleLend acts as an intermediary and is not a party to the rental agreement.
LittleLend is not liable for the quality, safety, suitability, or legality of Products, accuracy of descriptions, performance by Users, loss/theft/damage, injury or material damage, disputes, or conduct of Users.
LittleLend is not liable for unavailability, outages, data loss, unauthorized access, or malware.
Insofar as LittleLend is liable for direct damage, such liability is limited to the amount paid out by its insurance plus the deductible.
If no payout occurs, liability is limited to €500 per incident and €1,500 per year.
No liability for indirect damage, including consequential loss or lost profit.
These limitations do not apply in cases of intent or gross negligence by LittleLend.
The User indemnifies LittleLend against third-party claims arising from use of the Platform or violation of these terms.
17. Force Majeure
LittleLend is not obliged to perform its obligations in case of force majeure.
Force majeure includes, among others, internet/telecom/power failures, cyberattacks, outages of third parties (such as Stripe), government measures, natural disasters, pandemics, and strikes.
If force majeure lasts longer than 90 days, either party may terminate without compensation.
18. Complaints
Complaints can be submitted via the contact form.
LittleLend aims to handle complaints within 14 days.
If dissatisfied, disputes may be submitted to the competent court or a recognized dispute committee.
19. Governing Law and Disputes
Dutch law applies.
Disputes shall be submitted to the competent court in the district where LittleLend is established, unless mandatory law dictates otherwise.
Consumers may, within one month after invoking this clause, choose the court competent under statutory law.
20. Final Provisions
LittleLend may amend these terms; changes will be communicated at least 30 days in advance.
The most recent version is available on the Platform.
Invalidity or nullity of any provision shall not affect the remainder.
